These Terms and Conditions will apply to the purchase of goods by you. These Terms and
conditions explain your rights and commitment in relation to our website and any goods
purchased through our site. By accessing our website and placing an order, you agree to our
terms and Conditions and are legally bound. You may only purchase goods from the Made To
Measure Wooden Gates Ltd website if you are eligible to enter into the contractual agreement
and are over 18 years of age.
This website is owned and operated by Made to measure Wooden Gates Ltd, The workshop to

Use of this site
This website is protected by copyright; it is owned by and licensed to Made To Measure Wooden
Gates Ltd. Any use of the website, its contents, copying or sharing is prohibited.
The pricing of goods and any additional charges are correct at the time of publishing, and we
ensure that goods and/or services have been described accurately to the best of our ability. All
weights, measurements and capacities, and delivery lead times quoted about the goods are
approximate only.
We strive to make our website virus and defect-free. However, it is your responsibility to ensure
that you have the correct equipment to use our website. We will not be liable to any person for
any loss or damage that may arise to computer equipment due to using the site.

Making a Purchase
We generally do not accept orders from outside of the United Kingdom mainland. If you want to
purchase from outside the mainland, don't hesitate to contact us to arrange a price, but be
aware that you may need to pay import duty or other taxes as we do not pay for these.
Payment will be taken in full at the time of the order.
We comply with the Data Protection Act 2018 and respect your privacy. By placing your order,
for you to buy our goods, you will be allowing us to use your personal details to supply goods by
our couriers and us.
You may correct any miscalculations or incorrect purchases at any time until you click “confirm”
during the ordering process. If, for any reason, you spot an error with your order after you have
clicked confirm. However, before we have placed it into the manufacture, we may still be able to
amend any errors providing you contact us immediately on 01964 541526 during working hours.
Please be aware that if we have started the manufacturing process, errors may not be rectified,
or charges may apply to make a change.
The moment you click confirm is counted as the ‘first working day’, and manufacturing will
commence.
The single gate width measurement entered into the order the gate will be made to that
measurement. e.g., Enter the width of 1000mm, and you will receive 1 gate leaf that will
measure 1000mm.
The double gate width measurement entered into the order that both gates will be made to that
total measurement. e.g., Enter the width of 3000mm, and you will receive 2 gate leafs that
will measure 1500mm each making a total of 3000mm.
The gate height measurement entered into the order the gate/gates will be made to that
measurement to the shoulder (hinge side) any bow or omega gates will be higher in the centre,
e.g., Enter a height of 2000mm, and you will receive your gate/gates that will measure
2000mm to the shoulder (hinge side)
Gate bracing and brace configuration may differ from the image shown if, in our opinion, this
would be more beneficial for strength and durability for the gate/gates.
All treatment colours are a professional semi-translucent coating, and the timber grain
underneath will show to keep the timber look. All colour shades are for guidance only, and
screens can show these differently. Shades may be either darker or lighter from the online
swatches on our website.
Timber, as being a totally natural product, may contain different timber shades from one gate
component to another, which should be expected with all timber
All online gate/s images including posts are for reference only and the actual finished product
can differ in being that the natural properties of the timber will show as natural timber on the
finished product.

Pricing
Prices on our website are the correct rate applicable at the time of ordering. All prices are
exclusive of VAT which will be included at checkout.
You will be contacted by email if at any time it is not possible to accept your order to buy goods
of the dimensions and at the prices indicated. We will, however, state in the email and
alternative offer. Prices and dimensions will be expressed in the email and affirm a period for
this offer to remain valid.

Availability
All products manufactured by Wortley Brothers Wooden Gates Ltd are bespoke and
manufactured to your specifications as stated by you in your order on our website.
Consequently, your order is subject to acceptance and availability of raw materials i.e timber . If
any ordered items can not be manufactured due to this, you will be contacted by email or phone
(if you have given us details). You will either have the option to wait until the item is available or
cancel that part of your order.

Quality
Extra care and attention are taken when manufacturing our wooden products to minimise the
effects of being a natural material and therefore minimizing susceptibility to movement due to
the environment in which they are used once they leave Made To Measure Wooden Gates Ltd.
We maintain high standards of longevity by using mortise, tenon and dowel joints on our frames
and then polyurethane glue to maximize strength and leave an allowance for the board to move
by leaving a rebate; this, along with using premium grade timbers extensively, helps reduce any
movements.
Timber is a natural product and consequently vulnerable to extreme changes in temperature
and weather conditions. There may be shape fluctuation in hot or wet weather; these can but
are not guaranteed to reverse when the weather returns. Also, please be aware that timber
posts can distort in some cases but also can but not guaranteed to return to shape when the
weather returns. Timber can split, warp, shrink, bow & twist but will not alter the structural
strength of the gate/gates or posts. Made To Measure Wooden Gates Ltd cannot prevent natural
warping, shrinking, bowing, twisting, splitting, mound, blue spots and any other movement once
the product has been accepted. Made to Measure Wooden Gates offer no reimbursement for
issues of this kind.
Wooden gates that are treated are to be maintained thereafter by the customer as the treatment
will need recoating during the gate/gates lifetime. Made to Measure Wooden gates Ltd cannot
cover any maltreatment of the gates.
We recommend that you treat your gates within four weeks of receiving them when they have
been climatized to the environment; Made To Measure Wooden Gates Ltd cannot be held liable
for any wood rot or mould due to a direct result of neglect. So we recommend you treat your
gates regularly; this includes gates treated by ourselves. You should maintain a good level of
protection for all of our products. Made To Measure Wooden Gates Ltd are not liable for bowing,
shrinking, twisting, moving, splitting, expansion or contraction caused and will not cover any
ensuing costs as a result of this.

Delivery
We predominantly offer delivery to mainland UK. It may not be possible for us to deliver to
certain locations, but you will be informed if required to pay extra for delivery by email when you
have clicked confirm. Please be aware; it might not be possible for us to deliver to some
locations.
We will not be liable for any loss or damage suffered by you through any delay due to
unforeseen circumstances outside of the control of Made To Measure Wooden Gates Ltd or any
of our courier companies.
Delivery of goods will be to the address you specified in your order. It is important that this
address is accurate. If you are unavailable for receipt of your delivery, please specify clearly
where you would like your goods to be placed. We cannot accept any liability for any loss or
damage to the goods once they have been delivered in accordance with your delivery
instructions.
If you do not accept our courier, we are not liable for damage caused during transit or delivery.
At the point of delivery, it is very important to check for damage or missing parts. If this is not
possible t, they should be signed for ‘unchecked’ or ‘damaged’ or ‘parts missing’ as appropriate.
In the unlikely event there is a problem with your delivery, you must notify us within 1 working
day of the delivery on 01964 541526 or by email at sales@madetomeasurewoodengates.co.uk Made To Measure Wooden
Gates Ltd cannot be held responsible for replacements or refunds for goods not signed for in
the correct manner.
When the goods have been delivered you become the owner. Once goods have been delivered
to you, they will be held at your own risk, and Made To Measure Wooden Gates Ltd will not be
liable for their loss, damage or destruction.
You must ensure that your goods will be delivered and checked before arranging the installation.
Made To Measure Wooden Gates Ltd are not liable for any subsequent losses you may incur
through missed delivery times or damage received during transit.
If any installation whatsoever in part or full occurs before informing us of any incorrect size,
delivery damage, faults, missing or incorrect items, then Made To Measure Wooden Gates Ltd
are under no obligation to repair, replace or refund them as well as any reinstallation costs.
Delivery will take place in between the hours of 6 am until 8 pm you must be available to accept
and sign for your delivery however you can ask for the goods to be left in a safe place or with a
neighbour etc. at your own risk, our transport will give you an estimated time slot on the morning
of your delivery so you can plan your day accordingly.

Ownership
You will only own the goods once they have been successfully delivered. Risk of damage to or
loss of the Goods passes to you at the time of delivery.

Installation
All goods must be installed correctly and apply strict building regulations. Any automated gates
must be pressure tested after installation and have additional safety edges/ photocells required
to ensure the gate meets all safety expectations. (Contact us for any safety advice on this
matter). Made To Measure Wooden Gates Ltd are not held responsible for any goods installed
by other parties for damage, injury or loss of life.

Cancellation of Contracts
Contracts cannot be cancelled if the goods you have ordered are bespoke, e.g. made to order
from your specifications; this covers all of the products we manufacture and supply or source.
This puts them outside of the Consumer Contracts (Information, Cancellation and Additional
Charges) Regulations 2013.
Manufacturing process of bespoke orders starts as soon as orders arrive into us as such
cancellation of contracts cannot be cancelled. It puts them outside of the Consumer Contracts
(Information, Cancellation and Additional Charges) Regulations 2013.
If you want to modify or add to your order, you should contact us asap.
All gate orders will be made to the measurements you have provided to us at the time of order
with a tolerance of 0 - 10 mm, we will not be responsible, and no refunds will be given for gates
ordered at the wrong size.
We will only pay for goods to be returned if deemed are faulty; otherwise, delivery must be
arranged and paid for by the customer.

Cancellation by Made To Measure Wooden Gates Ltd
Made To Measure Wooden Gates Ltd reserve the right not to process your order if:
● We cannot deliver to your area
● We have insufficient stock or raw materials to deliver the goods you have ordered
● Goods ordered are listed at an incorrect price due to a typographical error
● Goods ordered are listed at an incorrect price received by us from our suppliers.
If we cancel your order for any of the above reasons, we will notify you by e-mail and will refund
your account any sum debited by us from your credit/debit card as soon as possible.

Liability
If you do not receive goods ordered by you within 90 working days from the time frame stated
on which you ordered them in accordance with our Terms and Conditions and decide to cancel
the order rather than re-arrange delivery, we will provide you with a full refund. Please note this
does not apply to bespoke goods outside of The Consumer Contracts Regulations 2013.
Made To Measure wooden Gates Ltd are only responsible for losses that are a natural,
foreseeable consequence of our breach of these terms and conditions:
● We do not accept liability if we are prevented or delayed from complying with our
obligations set out in our terms and conditions by anything you (or anyone acting with
your express or implied authority) does or fails to do.
● We do not accept liability due to events beyond our reasonable control or for any cost
regarding the installation of the goods.
● We do not accept liability for any losses related to any business of yours, including but
not limited to: lost data, lost profits, lost revenues or business interruption.
● Your responsibility is to comply with all applicable regulations and legislation, including
obtaining all necessary customs, import and/or other permits to purchase goods from our
site.
● We do not accept liability or in respect of the export or import of the goods you purchase.
● We do not accept liability if certain national laws may prohibit the importation or
exportation of our goods to you.
You have certain rights as a consumer, including legal rights (e.g. under the Sale of Goods Act
1979 (as amended)) relating to faulty and/or misdescribed goods. Having said that, nothing in
these terms and conditions is intended to limit any rights you might have as a consumer under
applicable local law or other statutory rights that may not be excluded nor in any way to exclude
or limit our liability to you for any death or personal injury resulting from our negligence.

Notices
As stated in these terms and conditions, all notices from you to us must be in writing and sent to
our contact address at Workshop to the rear of 11 North Street, Leven, East Yorkshire HU175NF
We reserve the right to change these terms and conditions from time to time; please look
through them as often as possible.

Administration, Law and Language
Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
Any content contained within this website and any contract resulting from the use of this
website are governed by and construed in accordance with English law. Parties to any such
contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All
contracts are concluded in English
If any of these terms and conditions are unenforceable (including any provision in which we
exclude our liability to you), the enforceability of any of these conditions will not be affected.
